The Competition Tribunal decided to authorize, with no conditions, the inquired transaction by Cencosud S.A. and Cencosud Retail S.A., regarding the rental of five supermarkets, in the cities of Rancagua, Doñihue, Graneros and San Francisco de Mostazal. These supermarkets are currently managed by Comercial Condell. This decision was founded in the following: (i) the current restructuration process of the supermarket industry in Rancagua; (ii) after this restructure, supermarket providers will have several alternative potential buyers for their products; (iii) the existence of private labels does not affect this decision; and (iv) there are no foreseeable anticompetitive risks to this operation. Given this reasoning, the Competition Tribunal considered that proof of consumer benefits derived from the operation was not necessary. The Tribunal also took the projected cost savings and the increase of available products to the public into consideration.
