The Competition Tribunal dismissed a lawsuit by the National Economic Prosecutor’s Office against MK Asfaltos Moldeables Chile S.A., Productos Bituminosos S.A. and Química Latinoamericana S.A., in which the defendants were accused of coordinating prices and other competition variables, with the object of boycotting a public tender, published in the Chilean public tender website www.chilecompra.cl.
In its ruling, the Tribunal states that an agreement between the defendants, regarding their bids in the tender, could not be proven. Furthermore, the Tribunal states that, if that agreement had existed, it would not have been suitable for negatively affecting free competition in the market, given that, once the tender was declared desert, the allegedly colluded firms faced a competitive market. Therefore, there are no expected benefits from the accused conducts.
