The Competition Tribunal partially accepted a lawsuit by Sky Service S.A. against Ministerio de Transportes y Telecomunicaciones and Junta de Aeronáutica Civil, and against Lan Airlines S.A. and Lan Cargo S.A., regarding the June 25, 2005 tender to assign restricted international frequencies to Brazil. The Tribunal stated that the Supreme Decree D.S. N° 102, which regulates public tenders to assign international frequencies to national air transport companies, contains certain characteristics that restrict free competition in assigning restricted international frequencies; consequently, it proposes its modification.
